  1. Acceptance of Terms

    By accessing and using my website and services, you agree to abide by these Terms and Conditions. If you can not agree with any part of these terms, please do not use my services and get in contact with me to let us find a path that brings our two worlds together.

    Changes to Terms

    I may update these Terms and Conditions from time to time. It is your responsibility to review the terms periodically. Your continued use of my services after any changes indicate your acceptance of the updated terms.

  2. Description of Services

    I provide online room acoustics calculation tools and articles about acoustics. Most of the tools and features are free for personal use. In addition there are features everyone has to pay for, like calculating room modes for arbitrary shaped rooms in amroc pro.

  3. Commercial Use

    If you want to use my tools in commercial projects, you have to be my 'business user' on patreon.com.

    I want to keep most of amcoustics free for hobby acousticians while increasing the value for professionals! Ensure quality and new features in the future with that small fee.

  4. Limitation of Liability

    I strive to provide accurate and reliable tools, but I can not guarantee the accuracy or reliability of the results. I am not liable for any damages arising from any use of my services.

    No Service Level Agreement

    I can't offer hard service availability numbers in an SLA. As a one-person company, I can't ensure services are running (let's say I'm in a hospital, and the server goes down that same hour). That means there is no guarantee that amcoustics.com or any of its servcies are online. That being said, in the last 4 years, uptime has been ~99,9%. That's less than 10h per year downtime.

  5. Privacy Policy

    Protecting your privacy and data is important to me as a person. I love the web for being an endless source of knowledge and entertainment and I hate to see the countless pages that only exist to collect and sell data while offering little to no value to the world.

    amcoustics.com started as a spare time project and even if I try to make a living out of it now, I don't plan to betray my values as a long term www user.

  6. User Conduct

    You agree not to use the website for any unlawful purposes or in a way that violates these terms.

  7. Intellectual Property

    All content on the website is protected by intellectual property rights. You may not reproduce, distribute, modify or create derivative works without my explicit permission.

  8. Purchases and Refund Policy

    Most of the page's content is free for personal use and can be used in commercial projects via a monthly membership.

    I only sell one thing directly on my website for now:

    • You can buy the calculation of room modes in rooms with arbitrary shapes
      • amroc pro, the room mode calculator for arbitrary shaped rooms, is in beta version. That means, that only a small fraction of the planned features are available right now and the chance for any problems are high. While I try to minimize such problems with the help of a great group of voluntary testers, I can't guarantee the system is working or you get your results.
      • Therefor I start with a very low price to find problems while not hurting my users too much in case of a system failure.
      • My payment provider paddle.net does the heavy lifting. That's why you will see paddle.net as the company that collects your money on your bank transfer.

    Problems and Refunds

    Please message me if you have any troubles getting your results. If you insist on a refund within 7 days after your calculation request, I will provide it.

    Please note: As a one man company I try to minimize manual processes as much as I can, as it prevents me from spending time to improve the page. I therefore try to minimize the number of possible refunds as well, as those will be such manual processes. Nevertheless, it is also important for me to learn what is necessary to provide refunds early on, so don't hesitate to tell me about your problems and we will try to figure out a way that works for both of us, including manual processes like a refund.

    Note, that I write this initial paragraph before I have started to sell anything (September 2023). I will update this text as soon as I have experience with the topic.

  9. Jurisdiction

    Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in austria/vienna.

  10. Termination

    I reserve the right to terminate your access to my services at my discretion, without prior notice, if you violate these terms or engage in any harmful or unlawful activities.

amscan-specific Terms (iOS App)

The following terms apply to the use of the amcoustics iOS app amscan and are in addition to the general Terms and Conditions above.

  1. In-App Purchases

    The app offers one-time consumable in-app purchases (e.g., “Additional Room Modes”) through Apple’s App Store. These purchases are processed via Apple and refunds are managed by Apple in accordance with their policies.

  2. User-Generated Content

    During your app usage, your space data (room scan) is uploaded to our servers. You retain ownership of your content, but by using the app, you grant us a license to process this data for the purpose of acoustic modeling, product improvement and acoustics research. We may also share room scans with universities for the purpose of acoustic research.

  3. Data Retention & Deletion

    You can request the deletion of your uploaded space data by contacting us at remove(@)amcoustics.com and providing the Space ID, which is visible at the bottom of each detail page of scanned rooms. Once verified, your data will be removed from our servers.

  4. Disclaimer of Warranties

    All acoustic calculations are provided “as is” for educational and research purposes. While we strive for accuracy, we make no guarantee that the predictions are suitable for your usecase.

    Your room modes are calculated with the help of openCFS an open source multi-physics software co-developed by several European universities. Get in contact with us or the openCFS team if you think the room mode results are incorrect.
